The short answer
The E-2 Treaty Investor visa has no fixed minimum investment. Your investment must be “substantial” relative to the cost of the business, and the business must be real, active and able to grow.
If you’re a citizen of France or another treaty country and want to start, buy or run a U.S. business, the E-2 may be your fastest route.
Who qualifies?
- Treaty nationality. You must be a citizen of a qualifying treaty country, such as France, the UK, Germany, Italy, Japan or Canada.
- At least 50% ownership by treaty nationals, and you develop and direct the business.
- Funds at risk. The money must be committed or spent before you apply. Money sitting in a bank account doesn’t count.
- A real operating business. Passive investments such as rentals or stocks do not qualify.
- Not marginal. The business must do more than support your family. It should create jobs or real economic impact.
The mistakes we see most often
- Investing too little for the type of business. A $60,000 consulting firm and a $60,000 restaurant are judged very differently.
- A weak business plan. Officers want realistic 5-year hiring and revenue projections.
- Unclear source of funds. Every euro or dollar must be traced to a lawful source.
- Buying a business without legal review. Franchises and acquisitions must be structured correctly before closing.

What you get with an E-2
- Live in the U.S. and run your company.
- Your spouse can work in the U.S.
- Children under 21 can attend U.S. schools.
- Renewable as long as the business keeps operating.
