In most cases, however, this letter is an informational\n            privacy notice. It does not, by itself, mean that USCIS found a\n            criminal record or suspects that a marriage is fraudulent.\n        <\/p>\n\n        <p>\n            Some marriage-based green card applicants have recently received a\n            USCIS letter titled <strong>\u201cFBI Privacy Requirements for Biometrics\n            Collection by USCIS.\u201d<\/strong>\n        <\/p>\n\n        <p>\n            The notice explains how USCIS may use fingerprints and other\n            biometric information to request criminal history information from\n            the FBI. Those biometrics may be used to\n            verify identity and request criminal history information from the\n            FBI.\n        <\/p>\n\n        <p>\n            The notice explains how that information may be used and describes\n            the applicant\u2019s rights under federal law.\n        <\/p>\n\n        <p>The letter identifies two principal legal authorities:<\/p>\n\n        <ul>\n            <li>\n                <strong>28 U.S.C. \u00a7 534<\/strong>, concerning the collection,\n                preservation, and exchange of identification records.\n            <\/li>\n            <li>\n                <strong>28 C.F.R. \u00a7 50.12<\/strong>, which requires authorized\n                agencies to notify individuals when fingerprints will be used\n                to check FBI criminal history records.\n            <\/li>\n        <\/ul>\n\n        <div class=\"alo-callout\">\n            <strong>The most important point:<\/strong>\n            This letter is a privacy disclosure. It is not a Request for\n            Evidence, a Notice of Intent to Deny, an interview notice, or a\n            decision on the green card application.\n        <\/div>\n\n        <h2>Why Are Marriage-Based Applicants Receiving It?<\/h2>\n\n        <p>\n            The notice is connected to the collection and use of biometrics.\n            It is not based on the marital relationship itself.\n        <\/p>\n\n        <p>\n            In a marriage-based adjustment of status case, the foreign national\n            spouse generally files Form I-485 and provides fingerprints, a\n            photograph, and a signature. USCIS uses those biometrics as part of\n            the identity, background, and security screening required before\n            permanent residence can be approved.\n        <\/p>\n\n        <p>A marriage-based applicant may receive the letter because:<\/p>\n\n        <ul>\n            <li>\n                Fingerprints were collected for a pending Form I-485 or another\n                USCIS benefit request.\n            <\/li>\n            <li>\n                USCIS reused biometrics collected during an earlier immigration\n                matter.\n            <\/li>\n            <li>\n                USCIS submitted or resubmitted fingerprint information for an\n                updated FBI check.\n            <\/li>\n            <li>\n                USCIS is providing the privacy disclosure associated with\n                enrollment in its continuous vetting process.\n            <\/li>\n        <\/ul>\n\n        <p>\n            The sample notice states that USCIS has been transitioning since\n            2017 from screening conducted at a single point in time to an\n            event-based process known as\n            <strong>Continuous Immigration Vetting<\/strong>.\n        <\/p>\n\n        <p>\n            In practical terms, the government may receive updated criminal\n            history information connected to an applicant\u2019s biometrics while\n            an immigration matter remains under review. The notice does not\n            state that any adverse information exists.\n        <\/p>\n\n        <h2>Does This Mean USCIS Found a Criminal Record?<\/h2>\n\n        <p><strong>No.<\/strong><\/p>\n\n        <p>\n            The notice is not a criminal history report and does not identify\n            any arrest, citation, charge, conviction, or other derogatory\n            information.\n        <\/p>\n\n        <p>It is also not:<\/p>\n\n        <ul>\n            <li>A Request for Evidence;<\/li>\n            <li>A Notice of Intent to Deny;<\/li>\n            <li>A biometrics appointment notice;<\/li>\n            <li>An interview notice;<\/li>\n            <li>A marriage fraud investigation notice; or<\/li>\n            <li>A decision on the underlying application.<\/li>\n        <\/ul>\n\n        <p>\n            The appearance of the notice in a USCIS online account should not\n            be interpreted as either approval or denial of the underlying\n            application.
