L-1B Visa · Specialized Knowledge

Your Key Employee Knows Something No One Else Does. The L-1B Can Bring Them to the U.S.

The L-1B is one of the best tools for international companies, and one of the most frequently challenged. Approval usually depends on how the knowledge is explained.

Who qualifies?

  • The employee has worked at least 1 continuous year in the last 3 years for the foreign company.
  • The U.S. and foreign companies are related: parent, subsidiary, branch or affiliate.
  • The employee has specialized knowledge of the company’s products, research, techniques, tools or processes.

What counts as “specialized knowledge”?

It’s knowledge that is distinct or uncommon, and not easily transferred to someone else in a short time. For example:

  • An engineer who built the company’s proprietary software.
  • A technician trained on the company’s own manufacturing process.
  • A product specialist who knows how the company adapts its products for clients.
General skills, like being a good developer or marketer, aren’t enough. The petition must show why this knowledge, specific to this company, is needed in the U.S.

Key facts

  • Stay up to 5 years in total.
  • Spouses can work, and children can study.
  • Premium processing is available.
  • Companies with a Blanket L approval can file directly at a U.S. consulate, which is often faster.

Why L-1B petitions get denied

  1. The knowledge is described in vague, generic terms.
  2. The petition doesn’t explain how long it would take to train someone else.
  3. The U.S. job doesn’t clearly use the specialized knowledge.
