What You Need to Know About the New Alien Registration Requirement Under Executive Order 14159

On January 20, 2025, President Trump issued Executive Order 14159: Protecting the American People Against Invasion, which has major implications for noncitizens currently in the United States. This Executive Order directs the Department of Homeland Security (DHS) to strictly enforce the alien registration requirements outlined under Section 262 of the Immigration and Nationality Act (INA) (8 U.S.C. 1302).

What Is the Alien Registration Requirement?

Under the INA, all noncitizens 14 years or older who:

  • Were not registered and fingerprinted when applying for a U.S. visa, and
  • Are staying in the U.S. for 30 days or more

must apply for registration and fingerprinting.

In addition:

  • Parents or legal guardians of children under 14 must register their children.
  • Aliens who turn 14 must apply for re-registration and fingerprinting within 30 days of their birthday.
  • Once registered and fingerprinted (unless fingerprinting is waived), individuals over the age of 18 must carry evidence of registration with them at all times.

What’s New Under Executive Order 14159?

This Executive Order mandates DHS to treat failure to comply with alien registration as a civil and criminal enforcement priority.

This means:

  • Unregistered aliens may face fines, misdemeanor charges, and even incarceration.
  • DHS will actively pursue enforcement against individuals who have failed to meet these requirements.

To make the registration process more accessible, USCIS has introduced a new formG-325R, Biometric Information (Registration)—and an online registration process to help noncitizens comply with the law.
